"J&T Consulting" along with partner German Legal Firm reached the recognition and enforcement of the Georgian court decision in Germany.
The Tbilisi City Court considered the contractual dispute on the basis of a Georgian company's claim to the German company. The plaintiff requested to be paid pay the cost of the performed services.
With the help of ‘’J&T Consulting’’ and its German partners, the Georgian company has submitted the decision of the Georgian court to German court for recognition and enforcement.
The process of recognition and enforcement were complicated by two circumstances: a) The decision was made in the absence of the defendant and b) there was no precedent for recognition by the German court of the Georgian court decision on business dispute.
In the course of reviewing the issue of recognition and enforcement, the bankruptcy proceedings were initiated against the defendant. Initially, the German bankruptcy manager rejected the request of the Georgian company, but after the submission of a substantiated the request was confirmed.
‘’J&T Consulting’’ thanks to Professor George Svanadze. His dissertation in German language played an important role in accomplishing the case in favor of the Georgian company.
