Partner of our company Simon Takashvili and Senior Associate Mate Khvedelidze, by using the provisional measures as the representatives of the claimant company - “Georgian Post” in the transnational business dispute, were able to seize the assets of the Greek company within the Greek court's jurisdiction. Indubitably, this is important for the development of Georgian legislation and for legislation of EU Member State as well, also, in terms of the approximation of case law of both Georgia and EU Member State.
In this case, the subject matter of the dispute was related to the non-fulfillment of financial obligations under the contract. Therefore, according to the court decision, the payment of the disputed amount to the Georgian Post Ltd was imposed on the Greek Company Tbilisi Cit Court fully satisfied the claim of the Georgian Post Ltd and the Greek court secured this claim.
These are particularly consequential precedents in which Georgian pending and finished court cases are legally supported by EU Member State courts.
